1 · Acceptance and scope

Using FinanceFlow

These Terms of Use apply to the website at financeflow.com.au and the online information, enquiry forms, calculators, tools, communications and referral or introduction services made available by FINANCEFLOW PTY LTD (ACN 700 298 835), trading as FinanceFlow.

By accessing or using the website, you agree to these Terms. If you submit an enquiry or use a particular service, additional notices, consents or service-specific terms may also apply. If there is an inconsistency, the more specific terms will apply to that particular interaction to the extent of the inconsistency.

If you do not agree with these Terms, do not use the website or submit an enquiry.

2 · FinanceFlow's role

FinanceFlow Is Not a Lender or Credit Provider

FinanceFlow is an Australian credit intermediary platform. We help Australian businesses describe a finance need, identify potentially relevant finance pathways and, where appropriate, connect suitable enquiries with independent finance professionals or credit providers.

FinanceFlow does not itself:

lend money or issue a credit facility;
make a lending or credit decision;
guarantee approval, pricing, timing, settlement or availability;
set a lender's interest rate, fees, security requirements or credit criteria; or
replace the assessment, advice or disclosure obligations of the relevant finance professional or credit provider.

Commercial and business-finance focus

FinanceFlow's website and enquiry service are positioned for commercial and business-finance purposes. FinanceFlow does not offer personal or consumer loans through this website. The legal classification of a particular credit arrangement depends on its purpose and circumstances and should be confirmed by the relevant professional where necessary.

3 · Enquiries and introductions

How Enquiries and Referrals Work

When you submit an enquiry, FinanceFlow may collect information about the business, finance purpose, amount sought, timing and other relevant circumstances. We may use that information to identify potentially suitable pathways and determine whether an introduction may be appropriate.

By asking FinanceFlow to assist with an enquiry, you authorise us to contact you about that enquiry. Where an introduction is proposed, relevant information may be shared with a finance professional or provider in accordance with our Privacy Policy and any collection notice or consent presented to you.

An introduction is not an approval, recommendation or guarantee that a provider will offer finance, that a particular product is suitable, or that any transaction will proceed. You are free to decide whether to continue with an introduced provider.

Independent providers

Finance professionals, credit providers and other specialist providers introduced through FinanceFlow are independent of FinanceFlow unless we expressly state otherwise. Their own licence status, professional obligations, privacy practices, fees, assessments, disclosures and contractual terms apply to the services they provide.

4 · General information and tools

Website Content, Calculators and Indicative Results

FinanceFlow publishes general business-finance information and tools to help users understand possible pathways and indicative scenarios. Content is not intended to be a complete statement of all finance options, providers, criteria, legal requirements or market conditions.

Any calculator, business finance planning tool, repayment estimate, illustrative rate, example or result on the website is indicative only. It is not a quote, offer, credit assessment, approval or promise that finance will be available on the same terms.

Actual availability, rates, fees, repayment amounts, security requirements, documentation, approval and settlement depend on the relevant provider, facility and circumstances.

Before relying on an estimate

Use the website as a starting point, not as a substitute for a provider's assessment.

Where a decision has financial, legal, tax or accounting consequences, obtain advice or information appropriate to your circumstances before proceeding.

5 · Your responsibilities

Information You Provide

You are responsible for ensuring that information you provide to FinanceFlow is accurate, current and not misleading to the best of your knowledge.

You must not use the website or enquiry service to:

impersonate another person or business or submit information without authority;
provide information you know is materially false or misleading;
interfere with the security, availability or normal operation of the website;
introduce malware, malicious code, automated scraping or other harmful technology;
attempt to gain unauthorised access to systems, accounts or data; or
use the website in a way that breaches applicable law or infringes another person's rights.

FinanceFlow may decline, suspend or stop handling an enquiry where information appears unreliable, the enquiry falls outside our service scope, or continued use may create legal, security, fraud or operational risk.

6 · Fees and commercial arrangements

Fees, Brokerage and Referral Payments

FinanceFlow's enquiry and matching service is currently provided to business users without a separate FinanceFlow enquiry fee unless we expressly agree otherwise in writing for a particular service.

An independent broker, lender, credit provider or specialist provider may charge its own fees, commissions, interest, legal costs, valuation costs or other charges. Those amounts are determined by the relevant provider and should be disclosed by that provider where required before you proceed.

FinanceFlow may receive a referral fee, commission or other commercial benefit from a participating finance professional, credit provider or service provider when an introduction results in a transaction or other agreed outcome. The existence or amount of a payment can depend on the relevant arrangement.

If FinanceFlow provides a separate direct business service outside the finance enquiry/matching service, such as selected marketing, systems or automation support, separate scope, pricing or engagement terms may apply.

7 · No personal advice

General Information — Not Personal Financial, Legal, Tax or Accounting Advice

Unless expressly stated otherwise, information published or communicated by FinanceFlow is general information and does not take into account your complete objectives, financial situation or needs.

FinanceFlow does not provide personal financial advice, legal advice, tax advice or accounting advice through the website. A finance professional introduced through FinanceFlow may provide services within that professional's own authority, qualifications and obligations.

Before entering into a finance arrangement, review the relevant provider's documents, pricing, conditions and security requirements and obtain independent professional advice where appropriate.

8 · Availability and accuracy

Website Availability and Information Accuracy

FinanceFlow aims to keep website information useful and reasonably current, but information can change without notice. Finance products, provider policies, rates, fees, provider criteria, laws and market conditions can change after content is published.

We do not promise that the website will always be available, uninterrupted, secure, error-free or compatible with every device or browser. We may change, suspend, withdraw or replace website features or content where reasonably necessary.

Unless otherwise stated, the website's original text, design, branding, graphics, software presentation and other content are owned by or licensed to FinanceFlow and are protected by applicable intellectual-property laws.

You may view, print or save reasonable extracts for your own legitimate business use. You must not reproduce, republish, sell, commercially exploit, remove attribution from, or create a misleading association with FinanceFlow content without permission, except where permitted by law.

Third-party names, trade marks, content and materials remain the property of their respective owners.

Links are provided for convenience or context and do not mean FinanceFlow controls the third party or guarantees its content, security, availability or services.

When you leave the FinanceFlow website or engage an independent provider, that provider's terms, privacy policy, fees and other conditions apply. You should review them before proceeding.

11 · Liability and statutory rights

Liability, Exclusions and Rights That Cannot Be Excluded

Nothing in these Terms excludes, restricts or modifies a right, guarantee, condition, warranty, remedy or liability that cannot lawfully be excluded, restricted or modified, including any rights that may apply under the Australian Consumer Law.

Subject to those non-excludable rights and to the maximum extent permitted by law, FinanceFlow is not responsible for loss arising solely from:

the decision of an independent finance professional or credit provider to approve, decline, vary or withdraw a facility;
rates, fees, terms, security requirements, delays or settlement outcomes controlled by an independent provider;
your reliance on an indicative calculator result or general website information without obtaining appropriate confirmation;
third-party websites, systems or services outside FinanceFlow's reasonable control; or
events or interruptions outside FinanceFlow's reasonable control.

Where liability can lawfully be limited, any limitation will operate only to the extent permitted by applicable law. These Terms should not be read as excluding liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded.

12 · Privacy and communications

Privacy, Contact and Marketing Preferences

FinanceFlow handles personal information in accordance with its Privacy Policy and any applicable collection notice.

Submitting an enquiry authorises FinanceFlow to contact you for the purpose of administering and responding to that enquiry. Marketing communications are handled separately and, where required, are sent only with appropriate consent or another lawful basis and include an unsubscribe mechanism.

You can update marketing preferences or withdraw marketing consent using the instructions in a message or by contacting FinanceFlow. Opting out of marketing does not prevent necessary service or enquiry communications.

13 · Changes to these terms

Updates, Suspension and Severability

FinanceFlow may update these Terms from time to time to reflect changes to the website, services, business model or legal requirements. The current version will be published on this page with an updated revision date.

Changes apply prospectively from publication unless a different effective date is stated. Material contractual arrangements already entered into with FinanceFlow are governed by their applicable agreement and cannot be altered merely by changing this webpage.

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

14 · Governing law

Victoria, Australia

These Terms are governed by the laws applicable in Victoria, Australia. Subject to any rights you may have to bring a proceeding in another jurisdiction, the parties submit to the courts of Victoria and courts that hear appeals from those courts.
